How much does it cost to remove a caveat from a property?

At Caveat Removal Victoria, we offer four methods to remove a caveat on a property in Victoria.

These methods are:
1. By consent through a Letter of Demand,
2. Issuing a ‘Lapsing Notice’,
3. Voluntary withdrawal of a caveat you previously lodged yourself, and
4. Caveat Removal via the Supreme Court of Victoria.

As these methods pertain to differing circumstances and degrees of urgency, their prices vary.

The three most straightforward options are of course the most affordable:

  1. Letter of Demand$500 (inclusive of GST)
    This notice demands the removal of a wrongful caveat by the person that lodged it. It notifies that person that you are making an application to the Court that they pay your legal costs should court removal ultimately be required.

  2. Lapsing Notice$970 (inclusive of costs, disbursements and GST)
    For the non-urgent removal of a caveat, we issue a ‘lapsing notice’ to put the caveator on notice. Removal of the caveat then occurs unless they commence proceedings within 30 days.

  3. Voluntary Caveat Removal$330 (inclusive of GST)
    Otherwise known as caveat withdrawal, this is simply the removal of a caveat you have lodged yourself and no longer need to maintain.

  4. Supreme Court Application$13,200 (inclusive of costs, disbursements and GST)
    This is to make a fast application to the Supreme Court of Victoria for removal where the wrongful caveat is going to delay settlement or finance. In such cases the rewards usually outweigh the initial cost of making such an application. Download the ‘Going to Court’ document for more information about the court process.
