Urgent caveat removal via the Supreme Court of Victoria, on the other hand, is usually much more rapid and generally less than 10 days.
Non-urgent Caveat Removal – 55 days or longer
The methods of removing a caveat in a non-urgent scenario involve submitting a Lapsing Notice. In this case the caveator (person who lodged the caveat on the property) has 30 days to substantiate the caveat’s maintenance. However, the entire process from start to finish generally requires about 55 days. In cases where follow-up court action is required because the caveator does in fact commence proceedings against you, it can take longer to remove the caveat.
Urgent Caveat Removal – Less than 55 days
The Supreme Court of Victoria handles rapid applications for urgent caveat removal. This is especially important if the wrongful caveat is going to delay settlement or your ability to obtain required finance.
